GENERAL POLICY NOTICE — DEFINITIONS AND APPLICABILITY
— Effective Date: March 2026
— Applies To: All MyBoofola and BOOFOLA LLC Platforms, Services, and Applications
Defined Terms: Throughout this document, page, or policy (individually or collectively, a "Policy"), the following defined terms apply. Unless the context requires otherwise, these definitions govern regardless of the specific Policy in which they appear.
"Company," "we," "us," or "our" refers collectively to BOOFOLA LLC, a limited liability company, and all of its affiliated brands, divisions, and platforms, including but not limited to MyBoofola and all websites, applications, and services operated under the BOOFOLA LLC umbrella.
"MyBoofola" refers to the MyBoofola website creation and hosting platform and its associated brands, which may also be referenced as MyBoofola.us, MyBoofola.com, MyBoofola.net, MyBoofola.org, MyBoofola.biz, MyBoofola.xyz, MyBoofola.link, or under any other domain extension now or hereafter used by BOOFOLA LLC in connection with the MyBoofola brand.
"BOOFOLA LLC" refers to the parent legal entity, which may also be referenced as BOOFOLA, Boofola, or boofola. The primary corporate website is located at boofolallc.com.
"Site," "Platform," or "Service" refers to any website, web application, mobile application, or digital service owned, operated, or controlled by BOOFOLA LLC, including but not limited to myboofola.us, myboofola.com, myboofola.net, myboofola.org, myboofola.biz, myboofola.xyz, myboofola.link, boofolallc.com, and any other BOOFOLA LLC-operated domain or subdomain, whether currently active or launched in the future.
"App," "app," or "APP" refers to any mobile or desktop application offered or published by MyBoofola or BOOFOLA LLC, whether distributed through the Apple App Store, Google Play, or any other distribution platform.
"Users," "you," or "your" refers collectively to all persons who access or use the Site, Platform, or Service in any capacity, including registered account holders, paid subscribers, free-tier users, and any visitors to websites hosted on or operated through the Platform.
Scope and Applicability: This Policy, and each Policy within the MyBoofola and BOOFOLA LLC policy framework, governs your access to and use of the Site, Platform, and Service. By accessing or using any part of the Site, Platform, or Service, you acknowledge that you have read, understood, and agree to be bound by this Policy and all other applicable Policies in their entirety. All Policies are incorporated by reference into the MyBoofola Terms and Conditions of Use and form part of the binding legal agreement between you and BOOFOLA LLC and its subsidiaries/partners.
Where multiple Policies apply to a given subject matter, they shall be read together and construed as a unified framework. In the event of a direct conflict between the terms of a specific Policy and the Terms and Conditions of Use, the Terms and Conditions of Use shall control unless the specific Policy expressly states otherwise.
If you do not agree with any applicable Policy, you must immediately discontinue your use of the Site, Platform, and Service and, if applicable, terminate your account.

Introduction and Purpose:
This Acceptable Use Policy (“AUP” or “Policy”) governs the use of the MyBoofola website creation and hosting platform (“Platform”) by all registered users, account holders, and their website visitors (collectively, “Users”). MyBoofola, LLC (“MyBoofola,” “we,” “us,” or “our”) provides tools that allow customers to create, publish, and host websites for personal and commercial purposes.
By accessing or using the Platform, you agree to be bound by this Policy in its entirety. This Policy is incorporated by reference into the MyBoofola Terms of Service. If you do not agree with this Policy, you must immediately cease using the Platform and terminate your account.

Scope of This Policy:
This Policy applies to:
- All websites created, published, or hosted using the MyBoofola Platform
- All content uploaded to, stored on, or distributed through the Platform
- All hyperlinks, embeds, redirects, or other references included on Platform-hosted websites
- All promotional materials, metadata, and descriptions associated with Platform-hosted websites
- All Users, regardless of account tier, subscription plan, or geographic location

Prohibition on Adult Content:
3.1 Definition of Adult Content
For purposes of this Policy, “Adult Content” means any material that:
- Depicts or describes nudity, sexual acts, or sexually explicit conduct, whether real or simulated
- Is classified or marketed as “for adults only,” “XXX,” “mature,” or under similar designations
- Qualifies as “sexually explicit conduct” as defined under 18 U.S.C. § 2256
- Would require age-verification under any applicable federal or state law
- Contains graphic depictions of genitalia, sexual fetishes, or sexually suggestive material intended primarily to arouse
- Is associated with, or intended to facilitate, adult entertainment industries including escort services, cam sites, adult subscription content platforms, or similar
3.2 Prohibited Conduct — Hosting
Users are strictly prohibited from hosting or publishing any of the following on a MyBoofola website:
- Adult Content as defined in Section 3.1
- Pornographic images, videos, animations (including AI-generated imagery)
- Erotic literature, graphic sexual fiction, or explicit audio recordings
- Nudity presented in a sexual context, including partially nude imagery
- Adult-oriented dating or hookup service pages
- Sex toy, adult novelty, or sexual wellness product storefronts or catalogs
3.3 Prohibited Conduct — Linking and Referencing
Users may not use a MyBoofola-hosted website to:
- Link to, embed, or otherwise direct visitors to external adult content websites
- Include iframes, redirects, or widgets that display Adult Content from external sources
- Display banners, advertisements, or affiliate links for adult entertainment services or products
- Reference or promote specific adult content platforms in a way that facilitates access to Adult Content
3.4 Prohibited Conduct — Promotion and Marketing
Users may not use a MyBoofola-hosted website to:
- Advertise, market, solicit, or promote adult entertainment services of any kind
- Collect payments or subscriptions in exchange for access to Adult Content
- Recruit models, performers, or other individuals for adult entertainment purposes
- Display promotional materials that contain Adult Content or are designed to attract adult content consumers

Child Safety and CSAM Prohibition:
The safety of minors is a paramount concern of MyBoofola. The following are absolutely and unconditionally prohibited:
- Any content that sexually depicts, exploits, or endangers individuals under the age of 18, including cartoon, animated, or AI-generated depictions
- Child Sexual Abuse Material (CSAM) in any form, as defined under 18 U.S.C. § 2256 and 18 U.S.C. § 2252A
- Content that grooms, solicits, or facilitates contact between adults and minors for sexual purposes
- Content that targets minors with marketing for adult products or services
- Section 05
Age Verification Requirements:
Regardless of the prohibition on Adult Content above, if any User’s website involves any content subject to age-gating under applicable law, the User is solely responsible for implementing legally compliant age verification. MyBoofola does not provide age-verification technology and does not certify compliance with state-level age verification statutes, including but not limited to:
- Louisiana Act 440 (2022) and similar laws enacted in Texas, Arkansas, Utah, Mississippi, Virginia, Montana, and other states requiring age verification for adult content websites
- The federal PROTECT Act (18 U.S.C. §§ 2252B, 2257) and associated 28 C.F.R. Part 75 regulations requiring record-keeping for sexually explicit content
- Section 06
Additional Prohibited Content and Conduct:
In addition to the Adult Content restrictions above, the following are prohibited on the Platform:
6.1 Illegal Content and Activities
- Content that violates any applicable federal, state, or local law or regulation
- Websites that facilitate the sale or distribution of controlled substances, illegal firearms, or other contraband
- Content that constitutes fraud, phishing, identity theft, or financial scams
- Websites designed to circumvent legal process, sanctions, or export controls
6.2 Hate Speech and Harassment
- Content that promotes, glorifies, or incites violence or discrimination on the basis of race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or other protected characteristics
- Content designed to harass, bully, stalk, or intimidate specific individuals
- Doxxing or publishing private information of individuals without their consent
6.3 Intellectual Property Violations
- Websites that distribute copyrighted content without authorization, including pirated software, music, films, or publications
- Use of third-party trademarks in a manner likely to cause consumer confusion or dilute the mark
- Content that violates the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512
6.4 Malicious Code and Security Threats
- Hosting malware, ransomware, spyware, phishing pages, or exploit kits
- Websites designed to conduct DDoS attacks, credential stuffing, or other cyberattacks
- Content designed to deceive visitors into downloading malicious software
6.5 Spam and Deceptive Practices
- Websites primarily designed for search engine manipulation or link-farming
- Automated or bulk-generated content with no legitimate purpose
- False advertising, deceptive pricing, or misleading claims about products or services in violation of the FTC Act (15 U.S.C. § 45)
- Violations of the CAN-SPAM Act (15 U.S.C. § 7701 et seq.) or TCPA (47 U.S.C. § 227)
6.6 Privacy Violations
- Websites that collect personal data of minors in violation of COPPA, 15 U.S.C. § 6501 et seq.
- Non-consensual collection, use, or sale of personal data in violation of applicable privacy laws, including the CCPA, Cal. Civ. Code § 1798.100 et seq.
- Hosting hidden tracking technologies without required disclosures
6.7 Gambling
- Unlicensed online gambling websites or sports betting platforms in violation of UIGEA, 31 U.S.C. §§ 5361–5367
- Sweepstakes or lottery websites that fail to comply with applicable state laws
6.8 Weapons and Dangerous Items
- Websites that facilitate the unlicensed sale of firearms, ammunition, or firearm components
- Instructions for manufacturing illegal weapons, explosives, or other instruments of harm
- Content promoting or facilitating self-harm or suicide
- Section 07
Enforcement and Consequences:
MyBoofola reserves the right, but not the obligation, to monitor websites hosted on the Platform for compliance with this Policy. MyBoofola may also act upon reports submitted by third parties, law enforcement agencies, or automated detection systems.
A violation of this Policy may result in any or all of the following actions, at MyBoofola’s sole discretion:
- Issuance of a warning notice and requirement to cure the violation within 24 hours
- Temporary suspension of the offending website or the User’s account
- Permanent removal of violating content without prior notice
- Permanent termination of the User’s account with no refund of any prepaid fees
- Reporting of the User’s identity and conduct to law enforcement or regulatory agencies
- Civil legal action to recover damages, costs, and attorneys’ fees
MyBoofola is not obligated in any way to restore suspended or terminated accounts, websites, or content, even if a User disputes the violation finding.
Decisions regarding enforcement are final and not subject to appeal except as required by law.

MyBoofola is not responsible for content published by Users on Platform-hosted websites. MyBoofola operates as a hosting provider and may assert applicable safe harbor protections under 47 U.S.C. § 230 and 17 U.S.C. § 512, subject to applicable exceptions including those established by FOSTA-SESTA.
Users acknowledge that MyBoofola does not review all content prior to publication and that MyBoofola’s enforcement actions do not constitute a guarantee that all violating content will be detected or removed. Users are solely responsible for ensuring their websites comply with all applicable laws and this Policy.

Changes to This Policy
MyBoofola reserves the right to modify this Policy at any time. Changes will be effective upon posting to https://www.myboofola.com/legal/aup. Users will be notified of material changes via email or Platform notification at least 14 days prior to the effective date of the change. Continued use of the Platform after the effective date constitutes acceptance of the revised Policy.
